    Planning Scheme Amendments: Public Exhibition Stage

    Any person who may be affected by the planning scheme amendment may make a submission to the planning authority about the amendment. 

    This form has been prepared to assist in making submissions details.  There is no requirement under the Planning and Environment Act 1987 that you use this or any particular form.   (Please note that a separate process applies to planning permit applications and a different form must be used to object to a Statutory planning application)       

    Submissions to a Planning Scheme Amendment and Privacy

    Maroondah City Council (Council) is committed to protecting your privacy as prescribed by the Planning and Environment Act 1987 (PE Act) and the Privacy & Data Protection Act 2014 (PDP Act).

    Your submission and the personal information is collected by Maroondah City Council for the purposes of the planning process as set out in the Planning and Environment Act 1987 (PE Act).   Your submission is a public document.   Council must make a copy of every submission available in accordance with the public availability requirements until the end of two months after the amendment comes into operation or lapses, pursuant to Section 21 of the Planning & Environment Act 1987

    Name and contact details of submitters are required for Council to consider submissions and to notify such persons of the opportunity to attend Council meetings and any Panel Hearing held to consider submissions. 

    If a submission is made jointly by a number of people, the submission should nominate one person (name and address) as the group’s representative for notices and representation at a panel hearing, pursuant to Section 21A of the Planning & Environment Act 1987 (PE Act).  The PE Act allows for notices to be sent to one of the signatories of a petition.

    You must not submit any personal information or copyright material of third parties without their informed consent. By submitting the material, you agree that the use of the material as detailed above does not breach any third party’s right to privacy and copyright.

    What to know before making a submission

    Submissions must be made in writing giving the submitter’s name and contact address, clearly stating the grounds on which the amendment is supported or opposed and indicating what changes (if any) the submitter wishes to make.  You might wish to use the submission form template, but this is optional.

    To ensure Council considers your submission it should be received by the closing date shown on the notice of amendment. Submissions received after that date will be considered up until Council makes a decision. 

    Council will acknowledge receipt of your submission via email, or post if preferred. (See option selection below.)

    Following the consideration of submissions received during the amendment exhibition period, submissions will be reported to Council 

    Where submissions request a change to the amendment Council as the planning authority must either:

    • change the amendment as requested or 
    • refer the submission to an independent panel or 
    • abandon the amendment or part of the amendment.

    Council may also choose to refer submissions that do not require a change to the amendment to a panel.

    Council will advise submitters of any decision it makes for this Planning Scheme Amendment.

    How to make a submission

    Any person who may be affected by the Amendment may make a submission to the planning authority about the Amendment.  A submission can support, object or seek changes to the proposed amendment. 

    Submissions must set out the reasons why the submitter supports or objects to the Amendment and how the Amendment will impact the submitter.

    Submissions must be made in writing giving the submitter’s name and contact address, clearly stating the grounds on which the Amendment is supported or opposed and indicating what changes (if any) the submitter wishes to make.
