In accordance with s139 Local Government Act 2020 (the Act), Council must develop and adopt a Councillor Code of Conduct within four months after a general election.
In the interim, Councillors must comply with the existing Councillor Code of Conduct, as adopted by Council on 20 February 2017, pursuant to the provisions of section 76C of the old 1989 LGAct.
A Draft Councillor Code of Conduct 2021 has now been prepared based upon Council’s existing Councillor Code of Conduct, which has been amended to reflect new requirements under the Act, and the ‘Standards of Conduct’ expected to be observed by Councillors as prescribed in Local Government (Governance and Integrity) Regulations 2020.
The Draft Code of Conduct has also been benchmarked against Local Government Victoria’s ‘Engage Victoria’ list of topics that the local government sector considers is best practice.
Community consultation was undertaken from 15 December 2020 to 17 January 2021, following which it is proposed that Council, at its meeting on 15 February 2021, will consider all comments received and formally adopt a Councillor Code of Conduct.
